Transparency In Advertising, TV, and Movies Is Not A Bad Thing

New York passed a law requiring advertisements to disclose when they include an AI-generated “synthetic performer.” The law took effect on June 9, 2026. The state says the purpose is to help people understand when the “person” they see in an ad is not actually a real person.

The governor's office of New York put out a release stating that there's now a law that requires disclosure when ads include AI-generated performers.

What this means in normal terms

This is not about every use of AI in marketing.

It is mainly about ads that show a human-looking person created or altered by AI, where that person appears to be acting, speaking, modeling, endorsing, demonstrating, or otherwise performing in the ad.

In simple terms: if your ad uses a fake AI person who looks like a real spokesperson, customer, employee, expert, or model, you should disclose it clearly.

This is not a bad thing, nor will it be the last state law to do something like this.

To be honest, I can see how marketers would be upset about this. But in the long run, if the performance is good, or the advertisement hits then I don't see an issue.

Who should pay attention

Small businesses should pay attention if they run paid ads, social ads, video ads, display ads, landing pages, or promotional campaigns that may be seen by people in New York.

This is especially relevant for agencies, contractors, med spas, coaches, consultants, financial firms, legal marketers, home service businesses, healthcare-adjacent businesses, e-commerce companies, and anyone using AI avatars or generated people in ads.

“In New York, we are setting the rules of the road instead of letting AI run the show,” Governor Hochul said. “Requiring simple, honest disclosure when an ad uses synthetic performers protects consumers, respects our creative workforce and keeps New York at the forefront of responsible innovation.”

We're in a strange new era with artificial intelligence and it's good for government officials realizing that they can't just sit on their rumps and do nothing.

Additionally, Governor Hochul is now creating a first-of-its kind Office of Digital Innovation, Governance, Integrity, and Trust (DIGIT). DIGIT will serve as a central, authoritative body for digital safety and technological governance, devising new approaches and ensuring consistent enforcement to keep New Yorkers safe online; while protecting New York’s position as a state that values and invests in cutting edge innovation. The DIGIT Office will first focus on regulating large frontier AI developers, enabling greater transparency into their safety measures and establishing a reporting mechanism for developers to report critical safety incidents.

Honestly, I'm not surprised a Democratic-led state is at the forefront of this type of legislation. And not really shocked that it's New York either.
